Settlement by Arbitration
| What is Arbitration?
Arbitration is another form of dispute resolution. However, it differs from mediation in that the arbitrator, or panel of arbitrators, serve as judge and jury and render a decision in the case. The arbitrator or panel of arbitrators are neutral and have no interest in the case or ties with the parties involved in the dispute.
Although it is less formal than a jury trial, the parties have the opportunity to present evidence and testimony of witnesses at the arbitration hearing. The decision should be rendered in a few days and can be a binding or non-binding decision. In reaching a decision, the arbitrator(s) should follow the rules of law and case precedent in reaching a decision. In non-binding arbitration the parties can appeal the decision and request a trial de novo of their case.
Why Use Arbitration to Settle a Case?
Again, arbitration can be a means whereby the parties can achieve a speedier, less costly, resolution to their case.
